Our panelists will discuss the challenges of representing persons, adjudicated incompetent, in criminal matters. Specifically, they will address the intersection of guardianship and criminal law. They will illuminate the restrictions that guardians encounter when a disabled person is incarcerated. They will offer suggestions on how to assist guardians when faced with this issue.

Our panel will discuss various aspects of this issue including case studies addressing the problems faced by hospitals, long term care facilities and discharge planners; challenges faced by petitioning attorneys and guardians; the expectations of the probate court; Medicaid eligibility hurdles; verifying immigration status and any currently available or proposed strategies that might facilitate repatriation, naturalization or funding for health care needs.

A discussion of two case situations that illustrate granny snatches and transfer battles. Panelists will explain ways in which the proposed Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act (UAGPPJA) would alter the outcome of such cases and make disputes easier to resolve, less costly for the litigants, and provide the courts and practitioners more orderly process for resolving disputes.

Panelists will present cases that demonstrate the tension between autonomy and best interest that are common in guardianship practice. Each will share perspectives on these cases and include the audience in devising solutions.
